- In various other commentaries in the International Survey of Family Law, I have sought to point out the dangers of attempting to predict either the possibility of change or the manner in which that change will be effected or, indeed, the nature of such potential change. The year 2009, however, does seem to represent an exception in that jurisdictional changes have been effected to the Family Law Act 1975, as continuously amended, and there is the possibility of radical change to one, at any rate, of its less than totally successful amendments, as well as that amendment's being one of the most, apparently, radical in the substantive law. At the same time, 2009 has also seen not insignificant case-law in various areas of activity with which the Act has traditionally been concerned and which are of continuing interest. Also, 2009 has seen a major jurisdictional change in relation to property and maintenance as they affect the majority of heterosexual and same-sex unformalised couples. These matters will, on the breakdown of such relationships, be dealt with under the provisions of the Family Law Act 1975. These new provisions will be considered in more detail later in this chapter. All in all, as will be observed, 2009 has been an intriguing year in the development, in many planes, of Australian family law.
